Tech Company’s Post-Review Patent Fix Shows Need for Early Care

A wireless mesh networks maker was too late in fixing a mistake that led a U.S. Patent and Trademark Office tribunal to cancel one of its patents, which attorneys said highlights the need for attention to details during the patent application process.

The Patent Trial and Appeal Board said Sipco LLC’s correction to a “clerical error” in one of its technology patents after a board review didn’t have a retroactive effect. Sipco had secured a certificate of correction from the patent office months after the PTAB invalidated the patent.
