High Court Denies AIDS Group’s Gilead Patent Challenge, Others

The U.S. Supreme Court has denied a patent appeal brought by an AIDS nonprofit group, one of several intellectual property cases that the high court turned down Oct. 29.

The high court’s rejection of AIDS Healthcare Foundation Inc.'s petition means that a ruling from the U.S. Court of Appeals for the Federal Circuit stands. The appeals court said AIDS Healthcare didn’t have standing to sue to invalidate Gilead Sciences Inc.'s patents covering its antiviral agent, tenofovir alafenamide fumarate.
