Stanford Bid for Gene Inheritance Patent Falls Short Again (1)

A Stanford University invention for improved techniques for determining gene inheritance is ineligible for patent protection, the Federal Circuit affirmed.

The Patent Trial and Appeal Board upheld a patent examiner’s rejection of the Board of Trustees of the Leland Stanford Junior University’s application because the invention was drawn to abstract mathematical calculations and statistical modeling.

The U.S. Court of Appeals for the Federal Circuit agreed in a precedential opinion that the claims can’t be patented under Section 101 of the Patent Act. The appeals court upheld the rejection of a related Stanford patent application in a March 11 precedential opinion. ...
