Spotify USA Inc. can’t cancel a patent related to technology for creating a user profile based on an analysis of playlists, the District of Delaware ruled March 12.
It’s possible that creating the profile from playlists without user participation is an inventive concept, the court said. The ruling came in S.I.SV.EL Societa Italiana per lo Sviluppo Dell’elettronica S.p.A.'s lawsuit against Spotify and Rhapsody International Inc. for infringing five patents, including U.S. Patent No. 8,490,123. The ‘123 patent relates to a system for generating a user profile based on properties of the user’s playlists.
