Rockwell’s Trademark Claims Against Gray-Market Seller Survive

Rockwell Automation Inc. survived an attempt to end its trademark case against an alleged gray-market seller of its goods, in New Jersey federal court Dec. 30.

A 2017 Supreme Court ruling on patent infringement claims against resellers doesn’t bar Rockwell’s trademark infringement claims, the U.S. District Court for the District of New Jersey said.

Rockwell makes products for use in industrial automation systems and requires its authorized distributors to sell its goods only to customers that won’t resell them on the gray market.
