Power Plant Patent Suit Should Be Trimmed, Magistrate Judge Says

Several defendants should be dropped from Midwest Energy Emissions Corp.'s suit alleging power plants infringe patents related to removing mercury from coal emissions, a federal magistrate judge recommended.

Midwest’s third complaint doesn’t provide sufficient notice to 12 defendants, including Arthur J. Gallaher & Co. and DTE REF Holdings LLC, of what they are alleged to have done to infringe the patents, Magistrate Judge Christopher J. Burke of the U.S. District Court for the District of Delaware said. But his report and recommendation filed Thursday rejected calls from another 16 defendants to be dismissed for similar reasons.
