Nippon Shinyaku Fails to Halt Patent Reviews Sought by Sarepta

A federal judge denied Nippon Shinyaku’s request that rival Sarepta be forced to withdraw seven petitions for review of the validity of Nippon patents related to genetic therapy for Duchenne muscular dystrophy.

  • “Nippon Shinyaku has failed to persuade the court that it is likely to succeed on the merits, that it will suffer cognizable irreparable harm in the absence of extraordinary preliminary relief, that the balance of harms tips in its favor, or that the public interest warrants the relief that it seeks,” U.S. District Judge Leonard Stark said in opinion issued Friday in federal court in Wilmington, Delaware ...
