Marilyn Monroe Estate Can Pursue Endorsement Claims

Marilyn Monroe’s estate can go forward with claims that a vintage collectibles licensor has violated federal law by implying a false association with the deceased movie star, according to a Sept. 18 ruling by the U.S. District Court for the Southern District of New York (A.V.E.L.A., Inc. v. Estate of Marilyn Monroe, LLC, S.D.N.Y., 1:12-cv-04828-KPF-JCF, 9/18/15).

Leo Valencia, whose companies have created and marketed numerous items using images of dead celebrities and vintage cartoon characters, had initiated this action against the estate to get a ruling that he was not violating any rights held by the estate.
