Lego Overcomes ‘Monkie Kid’ Trademark Denial in Appeal Board Win

Lego beat back a trademark examiner’s refusal to register two “Monkie Kid” logos as the Trademark Trial and Appeal Board ruled the marks don’t need a disclaimer.

The precedential TTAB ruling said the logos, which include Chinese characters translating to the product’s English name, would be perceived as unitary marks by consumers. That meant Lego Juris A/S didn’t have to disclaim “Kid” as required by a trademark examiner’s refusal, the TTAB said.

Disclaiming part of a mark, often a word descriptive of a product’s characteristics or audience, limits a trademark owner’s protection by limiting its relevance in an infringement analysis. ...
