ITC Ordered to Consider Reducing $6M Penalty in Patent Fight

The International Trade Commission wrongly denied a satellite tech company’s request to toss or reduce a $6 million penalty in a patent infringement case, a federal appeals court said.

The U.S. Court of the Appeals for the Federal Circuit ruled Nov. 27 that the ITC erred when it considered a 2015 Federal Circuit ruling in the case to be the last word on the matter.

The ITC must now reconsider DBN Holding Inc.'s request to cancel or modify the penalty for violating a consent order to stop importing devices that infringed another company’s patents, even though the patents were later...
