Hewlett Packard Enterprise Co. will have to face allegations its SimpliVity cloud software infringes an Intellectual Ventures patent in a Texas federal court after failing to convince a judge to transfer the case.
Judge Alan Albright denied HP’s request to transfer the suit to Massachusetts, where HP says SimpliVity was originally developed. HP argued Massachusetts was a more convenient place to litigate than Albright’s Western District of Texas courtroom in Waco.
