High Court Orders Dismissal of Vets’ Agent Orange Suits

Vietnam War Veterans can’t go forward with their argument that a federal appeals court can second-guess Department of Veterans Affairs’ restrictions on who qualifies for compensation under the Agent Orange Act, the U.S. Supreme Court said June 24.

Two cases seeking Supreme Court review are moot because the underlying benefits claims are resolved.

The court’s order to remand and dismiss leaves in place a ruling by the U.S. Court of Appeals for the Federal Circuit that VA revisions interpreting the act that were published in its benefits manual aren’t reviewable.
