Google Denied Validity Challenges Because of Trial, PTAB Says

A Patent and Trademark Office tribunal shot down Google LLC’s efforts to invalidate claims in four patents it was sued for infringing, after considering factors in the district court litigation.

The Patent Trial and Appeal Board’s five decisions on the four patents were entered Monday. Also Monday, Google, Apple Inc., Intel Corp. and Cisco Sytems Inc. filed a lawsuit in the U.S. District Court for the Northern District of California, alleging the patent office’s passing on validity trials because of discretionary factors involving a pending parallel litigation—as is the case with the four patents—was illegal.
