The full Federal Circuit voted to rehear a case decided last month by a three-judge panel extending past benefits to a veteran who participated in secret government chemical agent testing.
The active judges of the U.S. Court of Appeals for the Federal Circuit will consider whether the panel’s ruling is in line with the U.S. Supreme Court’s and its own precedent. No party sought en banc rehearing; instead, the judges took the usual step of voting for it on their own.
