Fight Over Wire Transfer Payment Goes To Patent Office Leaders

Confirmation of a wire transfer should be proof that a company has paid the fees required to challenge a patent at an administrative tribunal, Toshiba America Electronic Components Inc. told a precedent-setting board.

The Precedential Opinion Panel agreed in September to consider whether confirmation of payment from the Federal Reserve’s Fedwire system is sufficient evidence the petitioner in a patent challenge has made the required payments.

The issue can be important for companies, like Toshiba, that have been accused of infringement and are up against a one-year deadline to file a request for inter partes review at the PTAB.
