Empire State Building Trust Sued Over Alleged Trademark Bullying

A New York real estate company sued the owners of the Empire State Building Friday to “vindicate” its use of an “Empire State” trademark in its residential real estate business.

Empire State Management LLC told a Brooklyn federal court that the Empire State Realty Trust has been trying to “monopolize” the use of “Empire State” by “harassing and bullying small businesses into changing their marks.”

ESM—a residential real estate company based in Brooklyn—said ESRT threatened it with a lawsuit based on its use of “Empire State” and a “generic skyscraper” logo, “both common symbols of New York.” ESRT owns federal...
