Dan Aykroyd’s Vodka Company Scores in Skull Bottle Battle

Comedian Dan Aykroyd’s Globefill Inc. vodka company won its trade dress infringement case March 29 against a distiller that also sells spirits in skull-shaped bottles (Globefill Inc. v. Elements Spirits Inc., C.D. Cal., 2:10-cv-02034, 3/29/17).

A U.S. District Court for the Central District of California jury found that Elements Spirits Inc.'s KAH tequila bottle infringed the trade dress in Globefill’s Crystal Head bottle.

The Crystal Head bottles are clear glass in the shape of a skull. The KAH bottles are also skull-shaped but have painted designs inspired by the Mexican Day of the Dead holiday. Both brands claim ...
