Court Should’ve Weighed Ban on Jeep Copycat’s Fix, 6th Cir. Says

Fiat Chrysler convinced the Sixth Circuit that a lower court should have considered banning an updated version of a Jeep copycat, despite the International Trade Commission finding it non-infringing.

The ITC had found Mahindra & Mahindra Ltd.'s 2018-2019 Roxor off-road vehicle model copied FCA US LLC’s Jeep trade dress, but determined that its 2020 model had “so many differences” that it no longer risked confusing consumers. A district court declining FCA’s bid to enjoin the modified 2020 Roxor, however, should have considered applying the “safe distance rule” for known infringers, the US Court for the Sixth Circuit said.
