Cisco Can’t Escape Network Patent Suit Over Inventor Issue

Cisco Systems Inc. must face allegations it infringed a patent related to virtual computer networks, even though Egenera Inc. was responsible for some “sketchy” conduct during a trial, a Massachusetts federal judge ruled.

Cisco said Egenera was guilty of “egregious litigation misconduct” because paid consultants testified falsely about the inventorship of U.S. Patent No. 7,231,430, downplaying the contributions of former Egenera employee Peter Schulter.

U.S. District Judge Richard Stearns in the U.S. District Court for the District of Massachusetts previously called the testimony an exercise in “historical revisionism.”
