Chinese Company Fails To Win High Court Review of ITC Ban

The International Trade Commission’s exercise of authority to bar synthetic rubber components imported from China due to trade secret misappropriation in that country won’t get U.S. Supreme Court review (Sino Legend (Zhangjiagang) Chemical Co. v. Int’l Trade Comm’n, U.S., No. 16-428, review denied 1/9/17).

The case, declined Jan. 9 by the high court, tested the impact the ITC can have over U.S. import policy. The ITC issued a 10-year ban against Sino Legend (Zhangjiagang) Chemical Co., despite rulings in Chinese courts clearing the company on a trade secret misappropriation charge filed by SI Group.
