Case: Unfair Competition/Standing (Cal. Ct. App., 1st Dist.)

Veeva Systems Inc. has pled sufficient facts for purposes of standing under California’s Unfair Competition Law, the Court of Appeal finds. Veeva has alleged that Quintiles IMS Inc.'s unfair practice of threatening to enforce its void noncompete agreement/nondisclosure agreement has resulted in the required economic injury because (1) Veeva was forced to restrict a former Quintiles employee’s employment activities with Veeva in order to avoid being sued and (2) Veeva had to seek legal and management counsel in preparation for possible litigation when Quintiles told Veeva it must comply with its obligations under the NCA/NDA or face legal action.
