A federal district court in Texas granted in part and denied in part Rolex Watch U.S.A.'s motion for summary judgment and denied BeckerTime LLC’s motion for summary judgment in this action alleging counterfeit and infringing use of Rolex’s trademarks. Rolex sued BeckerTime, alleging counterfeit and infringing use of Rolex’s trademark in connection with the advertising, promotion, service, and sale of watches and watch parts that are not authorized or sponsored by Rolex and that are not genuine products of Rolex, and both parties moved for summary judgment.
