A federal district court in California granted in part and denied in part Amazon.com Inc.'s motion to dismiss MasterObjects Inc.'s willful infringement claims in this action for infringement of a patent concerning asynchronous communication technology that allows search engines to suggest search terms based on the characters a user types into the search bar. The court ruled that MasterObjects sufficiently alleged pre-suit knowledge of the patent, but not knowledge of infringement, so its pre-suit willfulness claim failed. And the court said that Master Objects’ enhanced damages claims as to post-suit willful infringement survived because it was premature to dismiss them. ...
