A federal district court in New York granted in part and denied in part Sire Spirits LLC and Vetroelite Inc. and Vetroelite S.P.A.'s motions to dismiss E. Rémy Martin & Co.'s design patent infringement, trade dress infringement, and dilution suit. Rémy Martin claimed that Sire Spirits and Vetroelite’s bottle is so substantially similar to its patented bottle design that an ordinary observer would be deceived by it. The court ruled that Rémy Martin’s pleadings were sufficient and that it has personal jurisdiction over Vetroelite SPA under New York’s long-arm jurisdiction law.
