Case: Patents/Pleadings (N.D. Cal.)

A federal district court in California denies Kenu Inc.'s motion to dismiss this action seeking a declaratory judgment that IDStore’s cellphone holder mount for cars doesn’t infringe Kenu Inc.'s patents. IDStore sold its mount through Amazon.com, but Amazon removed the product pursuant to its lawsuit settlement with Kenu. IDStore pleads a justiciable case or controversy and establishes subject-matter jurisdiction. And IDStore alleges that the patents are invalid due to obviousness over five specific pieces of prior art. But IDStore’s inequitable conduct and California Unfair Competition Law claims are dismissed. The case is Dror v. Kenu, Inc., 2019 BL 423059, N.D. Cal., No. 19-cv-03043-LB, 11/1/19
