Case: False Advertising/Pleadings (D. Ariz.)

A federal district court in Arizona granted American Fitness Wholesalers LLC’s motion to dismiss this false advertising case. ThermoLife International LLC holds 23 separate and distinct patents that protect its development and use of ingredients in dietary supplements and food products, and it claimed that American Fitness falsely advertised certain products on its website as dietary supplements. The court dismissed ThermoLife’s false advertising claim, because it didn’t allege a cognizable commercial injury under the Lanham Act that was proximately caused by American Fitness.
