BDG Media Inc.'s motion to dismiss Tom Hussey Photography LLC’s copyright infringement action was granted by the federal district court in Delaware. Tom Hussey Photography claimed that BDG’s website Flavorwire hosted an article that described Tom Hussey Photography’s series of photographs titled “Reflections,” and displayed its nine copyrighted images. The court ruled that because BDG’s only alleged volitional act was acquiring a website that hosted allegedly infringing copies of its work, Tom Hussey Photography didn’t state a claim for direct copyright infringement.
