Case: Copyrights/Default Judgment (W.D.N.Y.)

A photographer is granted a default judgment against Smash.com Inc. The photographer alleges that Smash.com infringed his copyright in a photo of artist Joe Reginella next to one of his sculptures. Smash.com purportedly copied the photo off the website of the New York Post, which had licensed the photo and used a “gutter” credit. Smash.com allegedly intentionally removed the credit when it posted the photo on its own site. The case is Mantel v. Smash.com Inc., 2019 BL 397103, W.D.N.Y., No. Case # 19-CV-6113-FPG, 10/17/19.
