Broadcom Attack on Wi-Fi One Patent Overcomes Timeliness Defense (1)

Broadcom Corp.’s successful attack on Wi-Fi One LLC’s patent related to error-control protocols in data transmissions has survived an appeal.

The U.S. Court of Appeals for the Federal Circuit ruled Broadcom didn’t wait too long to bring its challenge, known as an inter partes review, at the Patent and Trademark Office. The Patent Trial and Appeal Board, the PTO body that decides IPRs, had rejected Wi-Fi One’s argument that Broadcom missed the deadline to bring its challenge, and invalidated the challenged patent claims.
