Bid to Recoup $308M Patent Award From Apple Gets Outside Backing

A federal court’s ruling tossing out a $308.5 million patent-infringement verdict against Apple Inc. was an “atomic bomb” remedy that should be overturned, a group supporting the patent owner told the Federal Circuit.

In March a U.S. District Court for the Eastern District of Texas jury found that Apple’s FairPlay software infringed Personalized Media Communications LLC’s patent for digital rights management. A few months later, Judge Rodney Gilstrap overturned the jury’s verdict, finding that Personalized Media intentionally delayed its application at the U.S. Patent and Trademark Office so it could get higher royalties later.
