BGOV Bill Summary: H.R. 2426, Copyright Small Claims Tribunal

A new tribunal to hear small copyright claims would be created by a modified version of H.R. 2426.

The measure would create a Copyright Claims Board within the Library of Congress’ Copyright Office to hear cases that parties voluntarily submit to it. Those accused of infringing could opt out within 60 days of receiving service of a claim against them, requiring the case to be re-filed in federal court or another forum, or to be dropped. Parties opting to use to the new process would waive their right to a jury trial regarding the dispute.
