Bedding Maker Wants No Full Court Review in Pillow Patent Fight

A bedding company is urging the Federal Circuit to pass on a rival’s request for the full court to review a decision wiping out Patent Trial and Appeal Board findings in a dispute over pillow patents.

Bedgear LLC argued in a brief filed Thursday that a three-judge appellate panel correctly concluded that the U.S. Patent and Trademark Office tribunal exceeded its authority when it canceled claims in its patents. The court vacated the board’s decision and returned it to the agency, handing a setback to Fredman Bros. Furniture Company Inc., which is seeking en banc review.
