Arctic Cat’s Watercraft Patent Win Over BRP’s Sea-Doo Upheld

Arctic Cat Inc.'s patents on an automatic control for personal watercraft to aid in steering away from a hazard wasn’t an obvious application of Bombardier Recreational Products Inc.'s jet boat technology, a federal appeals court ruled Dec. 7.

BRP, a spinoff of Bombardier Inc., appealed to overturn a district court’s $47 million award and ongoing royalty for patent infringement by its Sea-Doo products. BRP relied on a report prior to Arctic Cat’s invention describing use of BRP’s “Challenger” technology in personal watercraft.
