Allergan, Tribe Get Expedited Hearing in Restasis Patent Appeal

Drugmaker Allergan Plc. and the St. Regis Mohawk Tribe will argue in a U.S. appeals court in June that the U.S. Patent and Trademark Office lacks the authority to review the validity of drug patents owned by the American Indian tribe.

The U.S. Court of Appeals for the Federal Circuit said March 26 it would hear on an expedited basis an appeal filed by the tribe and Allergan after the PTO’s Patent Trial and Appeal Board rejected the tribe’s motion to dismiss a patent validity attack brought by Mylan Pharmaceuticals Inc.
