Abbott Labs Loses Bid to Escape HIV DNA Replication Patent Claim

Abbott Laboratories failed to show that part of a patent covering a method to create HIV proteins using recombinant DNA was invalid and so must continue to face Grifols Diagnostic Solutions Inc. and Novartis Vaccines and Diagnostics Inc.'s infringement claim, a Chicago federal court ruled.

The relevant part of the patent isn’t directed to a patent-ineligible process that occurs in nature, the U.S. District Court for the Northern District of Illinois said Tuesday.
