Firearms Exporter Suffers Setback in Trade Controls Lawsuit

A U.S. exporter and South African resellers of U.S. firearms failed to show that the State Department has essentially blocked them from engaging in their business, the Ninth Circuit said as it denied the companies’ request for a preliminary injunction Monday.

Robert D. Thorne exports firearms, ammunition, and security equipment from the U.S. to Dave Sheer Guns and its affiliates, which resell the guns in South Africa. The Directorate of Defense Trade Controls rejected a number of Thorne’s license applications to export to the Dave Sheer entities under the Arms Export Control Act and International Traffic in Arms Regulations.
