W. R. Berkley Unit Fails to Dodge Hurricane Damage Coverage Suit

An oil equipment manufacturer won a ruling to revive its insurance coverage lawsuit against a W. R. Berkley Corp. unit, after the Eleventh Circuit said the policyholder sufficiently showed its property damage derived from a hurricane.

The insurance policy taken out by the policyholder, Texas-based Advanced Indicator and Manufacturing Inc., covers wind damage brought on by Hurricane Harvey in 2017, the US Court of Appeals for the Eleventh Circuit ruled Monday in a decision reviving the company’s underlying lawsuit against the insurer, Acadia Insurance Co,
