Cincinnati Insurance Gets Eateries’ Virus Coverage Suit Tossed

The Cincinnati Insurance Cos. dodged several Pennsylvania restaurant owners’ attempt to win payouts for pandemic-related financial harm, after a federal judge found a lack of required physical loss or damage.

“There is no physical component to Plaintiffs’ loss,” Judge Joseph Leeson Jr. of the U.S. District Court for the Eastern District of Pennsylvania held Thursday, granting Cincinnati’s motion to toss the lawsuit.

The ruling is the latest to side with insurers facing more than a thousand cases brought by business policyholders over denied claims tied to the coronavirus.
