California Lawmakers Propose Deal on Medical Malpractice Cap (1)

Lawmakers, lawyers, and patient advocates agreed Wednesday on proposed legislation that would increase California’s medical malpractice pain and suffering limit from the current maximum of $250,000 set in 1975.

The new limits in the Medical Injury Compensation Reform Act, or MICRA, would increase to $350,000 for non-death cases and $500,000 for wrongful death cases after Jan. 1, 2023. Incremental increases over 10 years would bring the cap to $750,000 for non-death cases and $1 million for wrongful death cases.
