A New Jersey law legalizing recreational marijuana use doesn’t allow workers to sue employers for job discrimination, a federal judge ruled on an issue of first impression.
The ruling Thursday by the US District Court for the District of New Jersey granted a win to Wal-Mart Stores East LLC in a lawsuit by Erick Zanetich under the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act. CREAMMA didn’t expressly include a private right of action under its provisions and no other court had previously considered whether it “provides an implied” right, the ruling said.
