SpartanNash Wins $500,000 Severance Appeal Against Ex-Executive

SpartanNash Cos. successfully appealed a $500,000 severance award to a former executive of a corporate predecessor, when the Seventh Circuit ruled Thursday that the executive’s termination occurred after the expiration of his three-year employment contract.

John Cocquyt’s 2016 employment contract with Martin’s Super Markets “unambiguously states” that he’s entitled to a severance payment only if he’s terminated during the contract’s three-year term, the appeals court said. Because SpartanNash—which acquired Martin’s in 2018—terminated Cocquyt after the three-year period expired, he’s not entitled to severance under the agreement, the court said.
