LABOR BRIEFING: Tyson Pandemic Order Claim to Get 8th Cir. Test

In its battle to keep a set of Covid-19 worker death cases out of Iowa state court, Tyson Foods Inc. is pinning its hopes on the argument it stayed open during the peak of the pandemic pursuant to President Donald Trump’s executive order.

Federal Direction? The meat processing giant will need to convince the U.S. Court of Appeals for the Eighth Circuit that statements made by Trump and his administration support the company’s claim that it acted under the direction of a federal officer, and thus wrongful death lawsuits should remain in federal court.
