ICE Courthouse Arrests Barred in Massachusetts, for Now

Massachusetts prosecutors, public defenders, and civil litigants won a temporary freeze on U.S. Immigration and Customs Enforcement arrests in the commonwealth’s courthouses.

ICE is barred from implementing its January 2018 “Courthouse Civil Arrest Directive” under a temporary injunction issued by the District of Massachusetts June 20.

The injunction is appropriate because the plaintiffs have a strong likelihood of success on their argument that the directive exceeds the authority granted to ICE by Congress, the U.S. District Court for the District of Massachusetts said. That authority was granted in the civil arrest provisions of the Immigration and Naturalization Act.
