Federal judges are considering the legality of the Biden administration’s use of a Trump-era border policy that allows the immediate expulsion of many migrants attempting to cross into the U.S. during the Covid-19 pandemic.
A lower court in September ruled that the policy, known as Title 42, should be suspended while litigation plays out. The administration on Wednesday urged the U.S. Court of Appeals for the District of Columbia Circuit to scrap that decision.
