West Virginia Hospital Retirees Denied Order Halting Health Cuts

Retirees of West Virginia’s Cabell Huntington Hospital Inc. lost their bid for a preliminary injunction blocking announced cuts to their health coverage two weeks after a federal judge temporarily blocked the cuts in order to maintain the status quo.

The retirees failed to show that the relief sought by their lawsuit—reformation of their prior health plan and reinstatement of coverage—was available to them in their Employee Retirement Income Security Act lawsuit, Judge Robert C.
