The US Court of Appeals for the Fifth Circuit’s decision to affirm dismissal incorrectly held that examples of fraud raised in the complaint didn’t amount to more than mistakes or negligence, Bridgette Jacobs said in her petition to the Supreme Court docketed Thursday.
Jacobs’ complaint satisfied federal pleading standards by alleging both specific instances of false statements Walgreens made, and a fraudulent course of conduct, the petition said.
