Middle Georgia Family Rehab LLC’s appeal challenging a $10 million award in a False Claims Act case was dismissed for lack of jurisdiction.
Whistleblower Joshua Walthour and the government showed that the company and its owners improperly billed Medicaid and Tricare for occupational therapy services supposedly performed by two therapists after they ended their employment, a district court ruled in June 2022.
But the defendants’ appeal must be dismissed because the district court didn’t issue a final judgment, the US Court of Appeals for the Eleventh Circuit said in a Monday order.
