Universal Health Services Inc. and two subsidiary health care providers escaped a man’s lawsuit claiming he was unlawfully held in a mental health facility without his consent for 17 days, which allegedly included being physically restrained and drugged against his will, a Texas appeals court ruled.
The alleged conduct which James Snell complains of is “an inseparable” part of the rendition of health care, and therefore his claims constitute health-care liability claims, the Texas Court of Appeals, Fifth District said Monday. Texas requires a medical expert’s report to accompany such claims, which Snell didn’t provide, the court said.
