SCOTUS OK’s Providers’ Standing in Abortion Litigation (1)

Abortion providers in Louisiana are breathing a sigh of relief after the U.S. Supreme Court Monday ruled they can sue to assert their patients’ rights to terminate pregnancies before viability, in litigation over a restriction that would require doctors who perform abortions to have admitting privileges at local hospitals.

The decision on third-party standing will affect most cases in this area because providers usually file the actions contesting the constitutionality of state abortion laws. Patients rarely bring suit because they will have either had an abortion or a baby by the time a court could hear it.
