Roche Diagnostics Corp. can proceed on claims that the owner of a company that distributed diabetes test strips engaged in a scheme to defraud it of about $84 million in lost profits and unwarranted rebates, a federal court in Michigan said.
Christopher Shaya, the owner of Olympus Global LLC and Delta Global LLC, must answer claims he used his companies to buy not-for-retail-sale (NFR) diabetes test strips from Northwood Inc. and resell them in retail markets at a significant markup, the U.S. District Court for the Eastern District of Michigan said.
